Yes, if you sample from the original songs in our catalog you need to share a percentage of your songs revenue with the original sample rightsholders. The percentage of revenue that you need to share with the original sample rightsholders is both from master and publishing revenue. How much of your revenue you have to share depends on which category the sampled song is in and how long the sample is, as per the rate card below.
Master revenue is earned by your song from the master/recording through for example digital streaming, physical sales, sync etc and also collected by your Recording Rights Organization if you have one. (If you want to register with a RRO, you find a list of RRO's here.)
Revenue from digital streaming is collected by your distributor, and you report it to us along with any other revenue at least every 6 months.
If you use any of our preferred distributors and add us to your team for the song, any digital streaming revenue that you make will be reported and paid to us automatically so that you only need to report if you have any other revenue for your song.
Publishing revenue is earned by your song from the composition whenever your song is played in public and is collected by your Performance Rights Organization if you have one. (If you want to register with a PRO, you find a list of PRO's here.)
If you register your song with a PRO, you must include the original rightsholders of the sampled song in your works registration.
If you aren't a member of a PRO and don't want to collect your performance royalties, you still need to enter your full name as a writer when you clear the sample for your song. When the license is activated, we send a publishing notification to the original sample rightsholders so that they can register your song with their PRO and claim their share of your songs performance royalties.
The publishing revenue that you get from your PRO doesn't need to be reported to us, as you include the original rightsholders in your works registration. If you're song earns any publishing revenue that's not through your PRO, such as a part of a sync fee, this can be reported to Tracklib and we ensure it's paid forward to the publishers of the original sample.
